Introduction
These Terms and Conditions govern the use of the content offered by ZÜÜN (“We”, “Us”, “Our”), which include our App, Website, and Social Media (collectively “Products” and “Services” and “Products and Services”). ZÜÜN is a Product by Argento Technologies Limited – a company registered in the UK (124 Goswell Road, London, England, EC1V 7DP) which is responsible for processing personal data as described in our Privacy Policy. The terms “user” and “you” refer to an individual that uses our Products and Services or contacts us. Your use of our Products and Services is subject to our Privacy Policy, which forms an integral part of our Terms and Conditions.
By using our Products and Services you are subject to our Terms and Conditions and to any rules or policies applied by any app store provider (“Provider”) from where you downloaded our App. We license the use of our App to you on the basis of our Terms and Conditions. We remain the owner of our Products at all times.
App: refers to ZÜÜN, the mobile application developed and owned by Argento Technologies Limited, including all features, functionality, content, and services made available through it on iOS and Android platforms.
Products and Services: refer to all digital offerings provided by ZÜÜN, including but not limited to our App, Website, AI-powered insights, social media, user support, promotional activities, and any associated digital or physical materials.
User: refers to any individual who downloads, accesses, or uses our Products and Services (such as our app, website, or related services) whether registered with an account, signed up to our newsletter or community or in any other way engaged with ZÜÜN.
Content or Assets: refers to all materials available within or produced through ZÜÜN, including text, graphics, icons, images, design, audio, videos, data compilations, social media, advertising, software, code, our Products and Services and its respective content and other digital elements, whether owned by us or our licensors.
Check-In: refers to the daily reflections completed by Users within our App, where Users record information about their sleep quality, mood, stress level, nutrition, movement level, and activities as well as add further details through journals and selfies to support their self-reflection and wellbeing tracking.
AI-Insights: refer to automatically generated observations, reflections, or guidance provided by artificial intelligence system on a weekly basis in our App, based on the information Users Check-In Data as described in our Privacy Policy. These insights are for general wellbeing and educational purposes only and are not intended to constitute or replace professional medical or mental health advice. Insights are generated on Sunday 2am in your local time zone, subject to completing 5 check-ins in a week; the insight is based on the check-ins completed the week prior (Sunday - Saturday).
Selfies: refers to optional photographic entries captured by Users within our App to visually document and reflect on their personal wellbeing journey. Selfies are not included in the AI-Insights.
Journal: refers to the in-app free writing feature that allows Users to record their personal thoughts, reflections, experiences or any other information the user chooses to share. These entries are not included in the AI-Insights.
Profile and Account: refers to the User’s registered identity within our App, containing their personal information (such as name, email, date of birth and gender), preferences, and recorded data, including Check-Ins, Journals, and AI-Insights.
App Account and Subscription
To use our App, you must sign in using either your Apple ID or Google ID, and are subject to the rules by the respective providers available here: Apple Inc., Google Inc.. We offer three subscription frequencies, Monthly (billed monthly), Quarterly (billed every three months), and Yearly (billed annually). Payment for all subscriptions are taken in advance of the defined period. Our Terms and Conditions apply to all subscriptions. You may terminate your subscription at any time, in which case your subscription will remain valid for the subscription time you have already paid for. By subscribing to our App, you hereby consent to start using the Product immediately upon subscribing to one of our subscriptions. We reserve the right to change the subscription plans and subscription fees at any time.
Subscription purchases for our App through Providers (e.g. App Store, Google Play Store) are governed by the terms and conditions of the Provider. Accordingly, for any issues with payments, renewals and or refunds, please contact your Provider. Subscriptions purchased through in-app purchase can only be cancelled through your Provider. We does not have access to your billing information through any Provider and as such cannot issue a refund. To request a refund or for any issues with your subscription, or to cancel or end your account, please get in contact with your Provider. Please be aware that uninstalling, deleting, logging out or closing your account will not automatically stop your subscription; you can only cancel your subscription through your Provider. Details on how this can be done can be found on your Provider’s website or the Provider’s customer support.
Age
Our App is not for individuals under the age of 18. To use our App, you agree that you are at least 18 years of age or older. However, should the law require you to be older to lawfully use ZÜÜN, then you must abide by that law and be of the legal minimum age.
Using Our Products and Services
We are committed to ensuring our Products and Services are running as usefully and efficiently as possible. Accordingly, we reserve the right to make changes to our Products and Services at any time and reason to ensure this is possible.
It is your responsibility as the account holder to ensure your phone’s and App’s access are secure. This includes protecting your device from, and not limited to malware, viruses, or any other malicious programs; compromising security features; or any other activity that may impact or eliminate our Products’ and Services’ functionality. Similarly, if your device is not properly maintained or your device is not charged. We will not take any responsibility for the App’s functionality or access to the App should you not protect or maintain your device. The App requires a strong, active connection to the internet, either by Wi-Fi or your mobile network provider. We will not take any responsibility for the App’s functionality if you do not have access to strong, active or reliable connection to the internet, for whatever reason. If using ZÜÜN without Wi-Fi, relying on your mobile network provider, please be aware that the terms and charges agreed with your mobile network provider will apply. You are solely responsible for any such charges incurred when using our App.
We to ensure that our App is always updated, however we do rely on third parties to ensure App functionality and delivery to you. We accept no liability for any losses, whether that be direct or indirect, you experience as a result of relying fully on the functionality of our App.
At any time, we may issue updates, enhancements, or new versions of the App. The App’s availability and system requirements on iOS and Android may change without notice. Continued use of the App may require installing such updates or newer versions. We cannot guarantee that updates will always work with your iOS or Android version you have installed on your device at that time. At any time, we may also stop providing our App and may terminate use of it without giving notice of termination to you. We reserve the right to update, replace, or add third-party service providers at our discretion to maintain or improve the quality, performance, or security of our Products and Services. Unless we tell you otherwise, upon any termination: (a) the rights and licenses granted to you in these terms will end; (b) you must stop using our App, and (if needed) delete it from your device. If you are not the bill payer for the device on which you are using our App, please be aware that we assume that you have received permission from the bill payer for using the App.
Medical Disclaimer
Our App provides mobile self-reflection tools through daily Check-Ins, Journalling, statistics and analysis, and insights that are generated by AI which all serve to improve your wellbeing. Our Products and Services are not a health care or medical provider, and it should not be considered as or replace medical advice. We make no claims, representations or guarantees that our App provides a physical or therapeutic benefit. USING OUR APP IS NOT A REPLACEMENT FOR OR A FORM OF THERAPY NOR ARE THEY INTEDED TO CURE, TREAT OR DIAGNOSE MEDICAL CONDITIONS. PLEASE CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL BEFORE MAKING ANY DECISIONS OR TAKING ANY ACTIONS THAT MAY AFFECT YOUR HEALTH AND WELLBEING. IF YOU HAVE ANY MENTAL OR PHYSICAL HEALTH CONDITIONS, PLEASE CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL TO UNDERSTAND IF OUR APP IS RIGHT FOR YOU. IF YOU HAVE SERIOUS MENTAL OR PHYSICAL HEALTH CONDITIONS OR ARE AT RISK OF HARMING YOURSELF OR OTHERS, YOU SHOULD SEEK URGENT MEDICAL ADVICE OR CALL EMERGENCY SERVICES OR HELPLINE. You acknowledge that by using our App you are agreeing to receiving insights and analysis of your daily Check-Ins on a weekly basis, which are generated by AI. The information generated by the app should be viewed as general wellbeing guidance, however AI can make mistakes, and you should check important information before you act or make changes to your lifestyle and habits based on the information given to you. We do not provide medical or clinical services, and no aspect of the app should be interpreted as such. We will take no responsibility for any unintended outcomes or actions taken as a result of following the contents of the AI-generated insights or guidance within the app. You acknowledge that we have advised you of the necessity of checking if our App is right for you before using it.
Copyrights
Subject to our Terms and Conditions, we grant you a limited, non-exclusive, revocable license to download and make personal non-commercial use of our Products and Services. This includes downloading and making personal non-commercial use of our App on a mobile device. All Assets contained in our Products and Services are owned by us (or our affiliate and third-party licensors, providers and services), and are protected under applicable copyright, trademark, intellectual property and other proprietary rights. You agree and acknowledge that you shall not acquire any ownership rights in or to our Assets. Our Assets may not be used outside of what is described in our Terms and Conditions, and they are not intended for your commercial use. You are only authorised to share a limited amount of content provided by us on your personal social media accounts (the likes of Instagram, Facebook, X, etc.) granted it is not modified, malicious, false, misleading, containing inaccuracies, unlawful or generally objectionable. Additionally, you cannot distribute, download, reproduce, modify, transfer, create derivative works from, sell or exploit our Assets, Products and Services. All trademarks, logos, images, company names and brands referenced in our Assets, Products and Services are our property and you have no license or right to use, alter, remove or copy them. All unauthorised use or violations of our Terms and Conditions will have your rights to use our Products and Services terminated automatically and instantly and can subject you to legal liability.
User Responsibilities
You agree not to use our Products and Services for any illegal or malicious purposes, and you agree to comply with all laws, rules and regulations relating to the use of our Products and Services. You cannot engage with our Products and Services with the intent of building a competitive product or service of any other competitive practices. You may not misuse or interfere with the normal operations of our Products and Services or attempt to engage with our Products and Services through any other method other than through those available on our interfaces and described in our instructions.
Limitation of Liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE, OUR AFFILIATES, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER, OR LOSS OF USE, DATA, BUSINESS, REVENUES, OR PROFITS (IN EACH CASE WHETHER DIRECT OR INDIRECT), ARISING OUT OF OR IN CONNECTION WITH OUR PRODUCTS AND SERVICES AND THESE TERMS, AND WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. To the extent permitted by law, our aggregated liability, our affiliates, employees, agents, suppliers, licensors and vendors arising out of or in connection with the Product and Services, these Terms and Conditions and Privacy Policy will not exceed the lesser of: the amounts paid by you to us for use of our Products and Services at issue during the 12 months prior to the event giving rise to the ability. You use our Products and Services at your own risk. Our Products and Services are provided ‘as is’, without any warranties, and we or your Provider do not warrant that the Service and availability thereof will be uninterrupted or error free. We or your Provider do not assume any responsibility for errors or omissions in the information or software or other documents, which are referenced by or linked to. In no event shall we or relevant Provider be liable for any consequences of using links to third parties’ websites. Any Assets are intended for general information purposes only. We are not liable or responsible for any consequences of your having read or been told about such Assets as you assume full responsibility for your decisions and actions. Particularly, we, to the fullest extent permitted by law, make no representation or warranties about the accuracy, completeness, or suitability for any purpose of the Assets and information published as part of our Products and Services.
Applicable Laws and Jurisdictions
This Agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with the laws of England and Wales.
We and you, agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises from or in connection with this Agreement. For users located elsewhere, the laws of England and Wales shall still apply unless otherwise required by local law.
Revisions
We reserve the right to change or update our Terms and Conditions or any other of our policies or practices. These changes and updates can happen at any time, and we will notify users by publishing the changes and updates on this page. All changes and updates will be effective immediately upon publishing on this page. By continuing to use our Products and Services constitutes your agreement to abide by our changed or updated Terms and Conditions, policies and practices. At times we may also notify you of changes by means of email or notifications in our App.
General Clauses Regarding Mental and Physical Health Conditions
The content provided within our App, including any guidance, exercises, reflections, or wellness information, is for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. If you have been diagnosed with depression, anxiety, any other mental health condition, or physical health condition that may be affected by movement or changes in routine, please consult your doctor or qualified health professional before using our App or following any of its guidance.
By using our App, you confirm that you understand and accept that:
- You are responsible for your own physical and mental wellbeing;
- You are fit to participate in any suggested activities; and
- You will stop using our App and seek professional help if you experience distress, discomfort, or worsening symptoms.
